This Seminar is organized by the Institute of Law for Science and Technology, National Tsing Hua University, Perkins Coie LLP, and Perkins Coie Foreign Legal Affairs Attorneys at Law. Perkins Coie LLP’s partner Matthew Bernstein, counsel Harvey Chen, associate Irene Chang, together with KPMG Law Firm’s senior counsel George Chen and Taiwan Intellectual Property Court’s Judge Sung-Mei Hsiung, will analyze patent law decisions from the United States Supreme Court and Federal Circuit from 2016 and 2017 and their impact on Taiwanese companies, and provide strategic solutions in view of such new developments. The Seminar will also discuss how Taiwanese companies can protect their brands from confusion in the United States through trade dress and non-traditional trademarks.
 
本研討會係由國立清華大學科技法律研究所暨美國博欽律師事務所 (Perkins Coie LLP)，和博欽外國法事務律師事務所 (Perkins Coie Foreign Legal Affairs Attorneys at Law) 共同舉辦，並由博欽律師事務所之合夥律師薄麥特(Matthew Bernstein) 、顧問律師陳漢威(Harvey Chen)和律師張愛堂(Irene Chang)，以及安侯法律事務所(KPMG Law Firm)之資深顧問律師陳家駿(George Chen) 和台灣智慧財產法院熊誦梅法官(Sung-Mei Hsiung)，分享2016至2017年美國專利訴訟於最高法院SCOTUS、巡迴上訴法院CAFC許多最新重要案例之發展。會中將就台灣企業必須知悉之在美商業行為可能受到的法律挑戰、衝擊與實務上影響，並在商業模式上宜採之相關因應策略等議題進行交流。會中也將討論如何透過申請營業包裝及新興商標類別的方式保護銷售至美國的產品，及如何防止混淆性競爭商品在美國銷售。
